Employment Cause / Judgment

  1. 1 Whether the termination of the Claimant’s contract was unfair.
  2. 2 What remedies, if any, the Claimant is entitled to.

Ratio Decidendi

The court found that the Respondent failed to provide evidence of a hearing or any fair procedure before terminating the Claimant. The statutory requirements under sections 41, 43, and 45 of the Employment Act, 2007, were not met. The Claimant was not confronted with any particulars of a hearing, and the Respondent did not discharge its burden to prove the reasons for termination. Consequently, the termination was procedurally and substantively unfair. The Claimant was entitled to compensation, accrued leave, and pay in lieu of notice, less the amount already paid as terminal dues.

Court Disposition

Claim partly allowed. Termination declared unfair. Monetary awards granted subject to deduction of terminal dues already paid.

Orders

  • Respondent to pay Claimant Kshs 85,800 as compensation.
  • Respondent to pay Claimant Kshs 57,600 for accrued leave.
