Civil Appeal / Ruling on Application for Release of Security Deposit Pending Appeal

  1. 1 Whether the applicant is entitled to the release of Kshs. 3,000,000 deposited in court as security pending appeal.
  2. 2 Whether the delay in filing the record of appeal justifies the release of the security to the respondent.
  3. 3 Whether the late deposit of security in court affects the applicant's entitlement to the funds.

Ratio Decidendi

The court found that although the security was deposited outside the period specified in the order, it was nonetheless deposited, and the delay in filing the record of appeal was not entirely attributable to the appellant, as the proceedings were only certified recently. Releasing the security at this stage would contradict the purpose of the original court order granting stay of execution pending appeal and would defeat the ends of justice. The application for release of the security was therefore dismissed, and the appellant was directed to file and serve the record of appeal within 45 days, failing which the appeal would stand dismissed.
