As such, the circumstances did not justify deeming the notice of appeal as withdrawn under Rule 85 of the Court of Appeal Rules, 2022. The application was therefore without merit, as the respondent's actions complied with the procedural requirements and the delay was properly accounted for by the certificate issued by the Registrar.
