Procedural Posture

Employment and Labour Cause / Judgment

  1. 1 Whether the Claimant is entitled to recognition by the Respondent under section 54 of the Labour Relations Act.
  2. 2 Whether the Respondent is obligated to implement deduction and remittance of union dues from the Claimant’s members.
  3. 3 Whether Ephraim Baraza’s contract of service was unlawfully terminated by the Respondent.

Ratio Decidendi

The Claimant failed to provide competent evidence or witness testimony to substantiate its claims for recognition and union dues deduction. No representative of the Claimant testified or provided a witness statement on these issues, and the only witness called, Ephraim Baraza, was not competent to address union recognition or dues matters. Consequently, these claims failed for want of proof. Regarding Ephraim Baraza, the court found that the Respondent did not terminate his employment but that he absconded duty. The Respondent consistently maintained, including in correspondence with the Ministry of Labour, that Baraza was free to resume work, and this was communicated to the Claimant....

Court Disposition

Claim for recognition and union dues deduction dismissed; order for employee to resume duty; no back pay; each party to bear own costs.

Orders

  • The Claimant's prayers for recognition and deduction/remittance of union dues are dismissed for want of proof.
  • The Respondent is ordered to allow Ephraim Baraza to resume duty immediately.
