The applicant failed to provide a reasonable and satisfactory explanation for the delay of 485 days in filing the memorandum and record of appeal. Although the applicant claimed the delay was due to late supply of proceedings and judgment, it did not annex a certificate of delay from the registrar of the superior court as required under Rule 84(1) of the Court of Appeal Rules. Without this certificate, the applicant could not benefit from the exclusion of time provision. The court found the delay to be inordinate and the explanation insufficient, rendering the applicant undeserving of the court's discretionary extension of time. Consequently, the application was dismissed for lack of merit.
