Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant was unlawfully terminated for demanding compensation for a workplace injury.
  2. 2 Whether the respondent followed due process in terminating or suspending the claimant.
  3. 3 Whether the claimant is entitled to compensation for unfair termination and other remedies.

Ratio Decidendi

The court found that the respondent failed to provide any documentary evidence or call witnesses to substantiate the alleged misconduct by the claimant or to prove that due process was followed in suspending or terminating him. There was no termination or suspension letter, nor evidence of disciplinary proceedings. The respondent did not discharge the statutory burden of proving a valid reason for termination as required by the Employment Act. The court held that the termination was unfair and unlawful, and the claimant was entitled to compensation for unfair termination, salary in lieu of notice, and unpaid days worked. The claim for untaken leave was disallowed due to lack of proof.

Court Disposition

Judgment for the claimant.

Orders

  • Respondent to pay claimant one month salary in lieu of notice (Kshs 15,000).
