The High Court found that the entire actus reus of robbery with violence occurred in Uganda, outside Kenyan territory, and thus the trial court lacked territorial jurisdiction under sections 5 and 6 of the Penal Code. No part of the offence was committed in Kenya, and the evidence did not support a finding that any element of the robbery occurred within Kenyan jurisdiction. As a result, the trial was a nullity. The alternative charge of handling stolen goods, being dependent on the main count, could not stand once the main count was found incompetent for want of jurisdiction. The conviction and sentence were quashed, and the appellant was ordered released unless otherwise lawfully held....
