The court found that the defendant failed to meet the threshold for grant of stay pending appeal as he did not demonstrate substantial loss or offer security for due performance of the decree. The only requirement met was that the application was made without unreasonable delay. Furthermore, the court noted that execution of the orders was not possible because Absa Bank denied the existence of the relevant account and any relationship with the defendant, making the threat of execution non-existent.
