Ratio Decidendi

The court held that under Section 91(6) of the Land Registration Act, the sale of a co-owned property cannot proceed without the written consent of the co-owner(s). The applicant's inability to obtain such consent does not entitle him to have the Deputy Registrar sign on behalf of the co-owners or to dispense with the statutory requirement. The court reaffirmed its earlier position that, while the applicant is at liberty to execute the decree, he may not sell the property without the co-owner's consent. The application was therefore found to lack merit and was dismissed.
