The court found that although there was no decree capable of execution, the application for stay to maintain the status quo was proper in the circumstances, given the risk of irretrievable loss of the property if the applicant was evicted before the appeal was heard. The applicant demonstrated sufficient cause, the appeal was not frivolous, and there was no unreasonable delay in bringing the application. The court balanced the risk of substantial loss to the applicant against the injustice to the respondent of being deprived of rent, and imposed a condition that the applicant deposit Kshs.40,000 per month in a joint interest-earning account as security.
