Ratio Decidendi

The court found that the certificate of costs issued to the Advocate had not been set aside or altered and was therefore final as to the amount due. The Client did not oppose the adoption of the taxed costs as a judgment sum but objected to the accrual of interest from the date of filing. The court held that under Rule 7 of the Advocates Remuneration Order, interest at 14% per annum is chargeable from one month after delivery of the bill to the client, provided the claim for interest is raised before payment. Although there was no documentary proof of the exact date of delivery, the court inferred from the proceedings that the Client was aware of the bill as of 25th August 2020....
