The court found that although both the trial court and appellate court have jurisdiction to hear applications for stay of execution, the existence of a similar application for stay pending before the Court of Appeal involving the same parties, subject matter, and relief sought rendered the present application sub judice. The court held that pursuing parallel proceedings in two courts over the same issue constitutes an abuse of the court process and offends the doctrine of sub judice.
