The court found that the order of 27th September 2016 only stayed the registration of persons elected as Archbishop in the elections scheduled for that date and did not prohibit future elections. There was no valid or subsisting order staying the election of the Archbishop scheduled for 9th January 2017. The applicant failed to amend his pleadings to seek prohibition of future elections and thus could not obtain interlocutory relief for which there was no substantive motion. The applicant also failed to disclose material facts, namely the existence of an order from the ELRC (a court of equal status) sanctioning the elections and declaring him retired.
