The court found that although there may have been grounds for dismissal, the Respondent failed to accord the Claimant procedural fairness as required under Section 41 of the Employment Act and Article 47 of the Constitution. No sufficient evidence was adduced to prove the alleged gross misconduct. The Claimant was therefore entitled to compensation for unfair dismissal, but not to service pay or three months' notice pay, as these were not contractually or statutorily justified.
