Procedural Posture

Civil Appeal / Stay Application

  1. 1 Whether the applicant has satisfied the conditions for grant of stay of execution pending appeal under Order 42 Rule 6 of the Civil Procedure Rules.
  2. 2 Whether substantial loss will result to the applicant if stay is not granted.
  3. 3 Whether the applicant has provided adequate security for the due performance of the decree.

Ratio Decidendi

The court found that the applicant had not demonstrated substantial loss, as the respondent sufficiently rebutted the allegation of inability to refund the decretal sum. However, the court considered the substantial amount involved and the applicant's willingness to provide security. The application was brought without undue delay. In the interests of justice, the court granted a conditional stay of execution, requiring the applicant to pay part of the decretal sum to the respondent and deposit the balance in a joint interest-earning account, failing which the stay would lapse.
