Ratio Decidendi

The court found that the appellant had demonstrated, on a balance, that it would have great difficulty recovering the decretal sum from the respondent should the appeal succeed, as the respondent did not deny the appellant's assertions nor provide evidence of assets or means to refund the sum. The court held that the application for stay was made without unreasonable delay and that the appellant was prepared to provide security for the due performance of the decree. Consequently, the interests of justice required that a stay of execution be granted, conditional upon the appellant depositing the decretal sum in a joint interest-earning account within thirty days.
