The Court found that although the respondent filed the notice of appeal before obtaining leave, the High Court subsequently granted leave to appeal against the ruling in question. The Court held that the subsequent grant of leave cured the procedural defect complained of by the applicant. As a result, there was no basis to strike out the notice of appeal, and the application to do so was dismissed. However, since the defect was only cured after the application to strike out had already been filed, the applicant was awarded the costs of the application.
