The Court held that it lacked jurisdiction to entertain the Petition because the Petitioner had not exhausted the statutory appellate procedures provided under Section 77 of the County Governments Act and the Public Service Commission Act. The Constitution and statutes require that appeals from decisions of county public service boards be first determined by the Public Service Commission before recourse to the courts. The Court further found that the inability of the Commission to grant all remedies sought by the Petitioner did not excuse non-compliance with the exhaustion requirement.
