Ratio Decidendi

The court found that the application was fatally incompetent because the order of leave extracted was at variance with the order applied for, and the substantive motion sought relief in respect of a decree from a case (H.C.C.C. 237 of 2007) to which the applicant was not a party. The applicant's motion failed to comply with Order LIII rule 4(1) of the Civil Procedure Rules, as the relief sought in the substantive motion did not match the relief for which leave was granted. Furthermore, the applicant was not entitled to recover a decretal sum arising from civil proceedings in which it was not a party. The court concluded that the application was fundamentally flawed and struck it out.
