The Supreme Court held that the High Court, sitting as an election court, has jurisdiction to determine the validity of an election, including issues of qualification and nomination, but only where such issues have not been conclusively determined by the IEBC, PPDT, or the High Court in judicial review or supervisory jurisdiction. Where a pre-election dispute has been conclusively resolved by the appropriate body and no appeal or review has been filed, the election court cannot revisit the matter as if it were an appellate body.
