The court found that the grant used by the 1st defendant to transfer parcel NYARIBARI CHACHE KEUMBU/3017 was revoked for being issued without jurisdiction and obtained fraudulently by omitting material facts, including the existence of daughters as beneficiaries. Section 93 of the Law of Succession Act does not protect transfers made under a void or fraudulently obtained grant. All subsequent transfers and sub-divisions of the property, including the amalgamation into parcel 3728, were therefore null and void.
