Ratio Decidendi

The court found that the claimant was dismissed without being afforded due process, as there was no evidence she was presented with allegations or given an opportunity to defend herself. However, since the dismissal occurred before the Employment Act, 2007 came into force, the repealed Employment Act, Cap 226 applied, which did not provide for compensation for unfair dismissal. The court therefore treated the summary dismissal as a normal termination and awarded the claimant one month's salary in lieu of notice, as stipulated in her employment contract. The court also ordered payment of all terminal benefits and accrued leave, and directed the respondent to issue a certificate of service.
