Ratio Decidendi

The Tribunal held that the orders sought to be set aside were not made in the present case and cannot be set aside through separate proceedings. The applicant failed to demonstrate that the court file in respect of BPRT No. 03/2019 (Machakos) was missing or lost, and did not apply for reconstruction of the file. The Tribunal found the application to be misconceived and an abuse of court process, as the issues raised could only be canvassed in the matter in which the order was made. Consequently, the application was dismissed with costs to the respondent.
