Legal Issues
- 1 Whether the applicant is eligible for early release from her sentence at this stage.
- 2 Whether the court should consider the file for decongestion before the applicant has three years left to serve.
Ratio Decidendi
The court held that the applicant, having served only five years of a ten-year sentence, is not eligible for early release at this time. The court further emphasized that repeated presentation of the same file for decongestion purposes, without a change in the applicant's eligibility status, is improper and contributes to judicial backlog. The court directed that the file should not be placed before it again until the applicant has only three years left to serve, thereby setting a clear threshold for reconsideration of early release applications in similar circumstances.
Court Disposition
Application for early release declined.
Orders
- The file shall not be placed before the court until the convict has a balance of only three years left to serve.

Ruling
1. The applicant was sentenced to serve ten (10) years imprisonment from 12/6/2018, as per the ruling of Mutende J dated 21/3/2022. She has so far served five (5) years only. She is therefore not eligible for release.
2. On 27/2/2023, this file was placed before me for decongestion and I declined to order her early release. The prisons officers are therefore causing backlog in this court by availing the same file.
3. I direct that the file shall be not be placed before the court until when the convict has a balance of only three (3) years left to serve.Orders accordingly.
