Ratio Decidendi

However, the court held that the plaintiff's suit was statute-barred under section 4(1)(a) of the Limitation of Actions Act, as the cause of action accrued at the latest in May 2009 and the suit was filed on 21st August 2015, beyond the six-year limitation period. Consequently, the suit was incompetent in law and was struck out with costs to the defendant.
