  1. 1 Whether the conviction of the appellant was safe in light of uncorroborated and inconsistent identification evidence.
  2. 2 Whether the trial magistrate erred by discounting the appellant's defence without proper analysis.

Ratio Decidendi

The High Court found that the complainant's evidence regarding the identification of the appellant was inconsistent and uncorroborated. The complainant confused the identities of the accused persons, and the only other eyewitness did not place the appellant at the scene. The trial magistrate failed to caution herself on the dangers of convicting on such uncorroborated and inconsistent evidence and did not properly address the discrepancies in the prosecution's case. As a result, the conviction was unsafe, and the appellant was entitled to the benefit of the doubt. The appeal was allowed, the conviction quashed, and the sentence set aside.
