Procedural Posture

Miscellaneous Application / Ruling on Interlocutory Application for Stay, Transfer, and Consolidation

  1. 1 Whether the proceedings in Tigania PMCC No. 74/2011 should be stayed pending the determination of Meru CMCC No. 224/2010.
  2. 2 Whether the two suits relate to the same subject matter and parties, justifying transfer and consolidation.
  3. 3 Whether the orders obtained in the two courts relate to the same or different parcels of land.

Ratio Decidendi

The court found that the applicant had demonstrated that the parcels of land in dispute in both suits are related, as parcels 4735 and 7670 were subdivisions of parcel 232, and the parties are substantially the same. The respondents did not deny these averments. To prevent conflicting decisions and multiplicity of proceedings, and in the interest of justice, the court held that it was appropriate to stay both suits and transfer them to the Environment and Land Court for consolidation, hearing, and determination. The court exercised its powers under Sections 6 and 3A of the Civil Procedure Act to grant the orders sought by the applicant.
