The sale agreement between the parties was valid and not null and void, but the Defendant failed to pay the full purchase price and continued to occupy the property without right. The Plaintiff, as registered proprietor, is entitled to exclusive possession and an eviction order. The Defendant is liable to pay mesne profits at Kshs. 60,000 per month from January 2009 until eviction, as this was the previously agreed rent. The Plaintiff is also entitled to costs and interest at court rates on the mesne profits and costs until payment in full.
