Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the Claimant by the Respondent was wrongful and unlawful.
  2. 2 What reliefs the Claimant is entitled to if the termination was unlawful.

Ratio Decidendi

Although the Respondent complied with the strict letter of the contract and the repealed Employment Act by paying one month's salary in lieu of notice, the failure to provide reasons for termination and to give the Claimant an opportunity to be heard constituted a breach of the rules of natural justice. The court found that, despite the legal framework at the time not requiring reasons for termination, the principles of fairness and natural justice were violated. Therefore, the dismissal was deemed unfair and unjustified, warranting an award of damages to the Claimant.

Court Disposition

Claim allowed. Termination found unfair and unjustified. Damages awarded.

Orders

  • The Respondent shall pay the Claimant 12 months salary as damages for unlawful termination, amounting to KES 1,036,800.
  • The Respondent shall pay the costs of the suit.
