The court further held that even if the Claimant had bypassed the CBA dispute resolution mechanism, the proper course would be to refer the matter to the appropriate forum, not to strike out the claim. Consequently, the Preliminary Objection did not meet the threshold set out in Mukisa Biscuit and was overruled with costs in the cause.
