Employment Cause / Judgment

  1. 1 Whether the dismissal of the claimant by the respondent was justified.
  2. 2 Whether the claimant was paid any dues by the respondents as alleged.
  3. 3 Whether the claimant is entitled to the prayers he has sought.

Ratio Decidendi

The court found that the respondent failed to follow mandatory pre-dismissal procedures as set out in the Employment Act 2007 and the Collective Bargaining Agreement. The claimant was not accorded a fair hearing, and the union was not notified of his suspension, both of which are procedural requirements. The criminal acquittal further weakened the respondent's justification for termination. The respondent did not prove payment of terminal dues. Consequently, the termination was held to be unfair and unlawful, entitling the claimant to compensation, payment of outstanding dues, and issuance of a certificate of service.

Court Disposition

Claim allowed in part; termination declared unfair; claimant awarded specified dues and compensation.
