The Tribunal found that although it has discretion under Order 21 Rule 12 of the Civil Procedure Rules to allow payment of a decretal sum by installments, the Judgment Debtor failed to demonstrate bona fides, seriousness in payment, or genuine difficulty sufficient to justify the exercise of such discretion. The Judgment Debtor had not made any payments since filing the application and provided no guarantee of future compliance. The Tribunal emphasized that the Decree Holder, who did not benefit from the loan but only acted as guarantor, should not be prejudiced by the Judgment Debtor's lack of action.
