The Court of Appeal found that the trial judge's award of Kshs 10,000 general damages was manifestly inadequate given the nature of the injuries, the period of pain and suffering, and the comparable awards in similar cases. The trial judge failed to consider the effect of inflation and did not refer to relevant precedents where higher awards were made for similar injuries. The appellate court held that the appropriate award for general damages should be Kshs 20,000, and accordingly allowed the appeal, set aside the lower award, and substituted it with the higher amount. The court also awarded costs of the appeal to the appellant.
