Ratio Decidendi

The court found that the Plaintiff was the registered proprietor of the Suit Property, having purchased it in 1997 when it was vacant. The evidence showed that the Defendants only began encroaching on the property around 2003, with permanent structures erected in 2008. The Defendants failed to prove continuous occupation for the requisite 12 years to establish adverse possession, as the period between their alleged entry and the issuance of the notice to vacate in 2008 was less than 12 years. Furthermore, the Defendants did not file a counterclaim for adverse possession as required by law. The Plaintiff's title was not extinguished, and the Defendants were found to be trespassers....
