The Court of Appeal held that although the issue of mistake was not pleaded by Mukabi, it was central to the dispute, featured in the list of issues, and was fully addressed in evidence and submissions by both parties. Therefore, the trial Judge did not err in entertaining the issue of mistake. However, the Court found that any mistake in the transfer of the suit properties could only vitiate the transaction between Mukabi and Monica, not Wairimu, who was an innocent purchaser for value and not party to the original agreement.
