Procedural Posture

Miscellaneous Application / Interlocutory Ruling on Prayers 5 and 6 of the Tenant's Application

  1. 1 Whether the tenant is entitled to compensation for loss of business during electricity disconnection.
  2. 2 Whether the landlord should be ordered to remove the wall painting of alcohol advertising logo.
  3. 3 Who is liable to pay costs of the application.

Ratio Decidendi

The Tribunal found that the tenant had not provided evidence of loss incurred during the period of electricity disconnection, and that the landlord's claim of disconnection due to illegal power connection raised factual disputes unsuitable for determination at the interlocutory stage. Similarly, the tenant failed to provide photographic evidence regarding the alleged replacement of her business advertising logo. Court Disposition

Interlocutory application partially allowed; substantive prayers deferred to main hearing.
