The court found that the applicant was not notified of the judgment date and could not have filed a notice of appeal within time against a judgment she was unaware of. Both parties were absent when judgment was delivered due to lack of notice, a fact admitted by the respondent. The court held that the delay in filing the notice of appeal was justified and not inordinate. In the interests of justice, and to avoid rendering the intended appeal nugatory, the court exercised its discretion to extend the time for filing the notice of appeal and granted a stay of execution pending the appeal. The application was therefore allowed as prayed.
