Ratio Decidendi

The court found that the sale agreement between the Plaintiff and the 3rd Defendant was void for all purposes due to the parties' failure to obtain Land Control Board consent within the statutory six-month period. As a result, the 3rd Defendant had no legal interest in the suit property and could not lawfully maintain a caution against it. The only remedy available to the 3rd Defendant was to pursue a refund of his deposit through a counterclaim, not to encumber the property. The Plaintiff established a prima facie case for removal of the caution and for injunctive relief, as the continued existence of the caution prevented her from dealing with her property.
