However, the plaintiff failed to provide sufficient particulars or evidence to prove, beyond reasonable doubt, that the 2nd defendant had disobeyed the court order by continuing construction on the suit land. As a result, the court found that the threshold for granting a committal order for contempt had not been met and dismissed the application with costs.
