The Tribunal found that the order of 19th September 2014, which stayed termination proceedings pending the determination of ownership, was based on the then-existing uncertainty regarding the lawful owner of the suit premises. However, the Environment and Land Court in ELC 93 of 2014 has since delivered a final judgment affirming the Landlady's ownership, and there is no pending appeal against that decision. The pending appeal (No. 226 of 2019) relates to a different matter (inclusion of a co-owner) and does not affect the Landlady's title. The doctrine of sub-judice does not apply as the subject matter and parties are not identical. Consequently, the circumstances have changed...
