The court found that although the plaintiff’s account showed a credit balance as at 7th May 2011, this was due to a system malfunction that failed to debit gambling transactions properly. The bank was entitled to retrospectively debit the account for those transactions once discovered, as the plaintiff had indeed transacted and benefited from the funds. However, the bank’s failure to address the malfunction in a timely manner, despite being aware of it, amounted to contributory negligence. As a result, while the plaintiff was not entitled to the claimed credit balance, the bank was also not entitled to recover the overdrawn sum from the plaintiff.
