Ratio Decidendi

The court held that the power of attorney expressly required that all business transacted under it, including legal proceedings, be conducted in the name of the donor, not the donee. The plaint was filed in the name of the donee, contrary to the mandate in the power of attorney. As a result, the plaintiff lacked the proper locus standi, and there was no privity of contract between the donee and the defendant. The suit was therefore improperly constituted and could not be sustained. The court struck out the plaint as prayed, with costs to the defendant.
