The applicant did not notify the defendants or their counsel of the inability to proceed with the case, resulting in inconvenience to the 6th defendant who had travelled from Nairobi for the hearing. The court held that the costs awarded were to compensate for this inconvenience and that the applicant did not meet the threshold for review under Order 45 of the Civil Procedure Rules. The application was therefore dismissed for want of merit, with costs to the 6th defendant/respondent.
