Miscellaneous Criminal Application / Ruling on Application for Non Custodial Sentence After Conviction and Withdrawal of Appeal

  1. 1 Whether the High Court has jurisdiction to revise a sentence after an appeal has been withdrawn and concluded.
  2. 2 Whether the applicant is entitled to a non-custodial sentence or consideration of time served under revision jurisdiction.

Ratio Decidendi

The High Court found that it lacks jurisdiction to entertain a revision application in respect of a matter where it has already concluded an appeal. The applicant, having withdrawn his appeal, cannot seek a more lenient sentence through revision in the same court. The only available remedy for the applicant is to appeal to the Court of Appeal. The application was therefore found to be without merit and an abuse of the court process.

Court Disposition

application dismissed

Orders

  • The application for a non-custodial sentence is dismissed as an abuse of court process.
