Ratio Decidendi

The High Court found that the trial court erred in apportioning liability to ZIQRA AUTO DELEARS, as there was no evidence that the third party notice was served and ZIQRA AUTO DELEARS was not properly enjoined as a party to the suit. The court held that, in the absence of proper third party proceedings, liability cannot be apportioned to a non-party. Consequently, the Respondent, as the only defendant properly before the court, must bear 100% liability for the accident and resulting damages. The assertion that liability findings in a related case (Gatundu SPMCC 152 of 2011) should apply was rejected, as each case must be determined on its own merits and parties properly before the court.
