Ratio Decidendi

The court held that Rule 7 of the Advocates (Remuneration) Order entitles an advocate to charge interest at 14% per annum on legal fees from one month after delivery of the bill, provided the claim for interest is raised before payment in full. The applicant had complied with this requirement by notifying the respondent in the fee note. The respondent's payment of the principal sum after the stipulated period did not extinguish the applicant's right to claim interest, as the claim was made before payment. The court found the applicant entitled to interest on the taxed costs from 10th May 2013 to 30th January 2015, and awarded costs of the application to the applicant.
