The declaration of goods as counterfeit, unless challenged and set aside through the proper statutory process, stands and precludes any cause of action for their return. The lower court erred in dismissing the application to strike out the suit, as the suit was untenable in law. The appeal was allowed, the application to strike out the suit was granted, and the suit in the lower court was struck out. Each party was ordered to bear its own costs on appeal, but the appellant was awarded costs in the court below.
