The tribunal found that the applicant established, to the required standard, the presence of a prohibited substance (EPO) in the respondent's urine sample, which constitutes an anti-doping rule violation under the strict liability regime of the ADAK Anti-Doping Rules and WADA Code. The respondent was properly notified and served, but failed to participate or provide any explanation for the violation or for the origin of the substance. As a result, she did not discharge her burden to demonstrate lack of intent or fault, which is necessary for any reduction of the standard sanction.
