The 2nd Defendant had not filed a defence to expressly rebut the Plaintiff's averments or plead misjoinder, leaving the Plaintiff's claim uncontroverted. The court held that a preliminary objection must be based on pure points of law arising from the pleadings, and in the absence of such pleadings from the 2nd Defendant, the objection was premature. Consequently, the court struck out the Notice of Preliminary Objection and directed the Defendants to file and serve their respective defences within twenty-one days.
