The Objector failed to prove on a balance of probabilities that he purchased 1.4 acres of the estate, as he provided no documentary evidence, did not specify from whom or when he bought the land, nor did he call any witnesses to the alleged transaction. The court found that the Objector was not entitled to a prior allocation of 1.4 acres. The estate, consisting of approximately 6.49 acres, should be distributed equally among the seven sons of the deceased in accordance with Section 38 of the Law of Succession Act.
